Counter Fraud

What is Fraud?

Basically explained fraud is where someone will cheat or trick someone into handing over money or property to them.

The Fraud Act 2006 created specific statutory offences of fraud and came into effect on 15th January 2007. The Act created new offences which replaced some offences previously contained within the Theft Acts 1968 & 1978.  The Act provides two basic requirements to prove a fraud.

·         The behavior of the Defendant must be DISHONEST [the Guilty act]

·         There must be an INTENTION to cause a GAIN or LOSS to ANOTHER [The blameworthy state of mind]
